These Terms and Conditions govern the provision of waste and rubbish removal services by Rubbish Removal Harringay to its customers. By making a booking, confirming a quote, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
1. Definitions
In these Terms and Conditions, the following words have the meanings set out below.
Company means Rubbish Removal Harringay, the provider of waste and rubbish removal services.
Customer means any individual, business, landlord, managing agent or organisation that books or receives services from the Company.
Services means any waste collection, rubbish clearance, bulky waste removal, commercial waste removal, garden waste removal, or related services provided by the Company.
Waste means any materials, items, goods, refuse or rubbish presented by the Customer for collection, removal, transport or disposal as part of the Services.
Site means the address or location where the Services are to be carried out.
2. Scope of Services
The Company provides on-demand and scheduled rubbish removal and waste collection services for domestic, commercial and other customers. The Services generally include loading of Waste, transportation, and delivery of Waste to an authorised waste transfer station or disposal facility.
The exact scope of the Services will be as described in the Customer's booking confirmation, quotation or agreed work order. Unless expressly agreed in writing, the Services do not include specialist cleaning, dismantling of structures, demolition, electrical works, plumbing works or removal of hazardous or prohibited materials.
The Company reserves the right to refuse to collect or handle any Waste that it reasonably considers unsuitable, unsafe, illegal to transport, or in breach of applicable waste regulations.
3. Booking Process
Customers may request a booking for Services by telephone, email or through any booking channels used by the Company. When requesting a booking, the Customer must provide accurate and complete information, including but not limited to the type and approximate volume of Waste, the Site address, access details, any parking restrictions, and desired date and time for the collection.
Any quote provided at the time of booking will usually be an estimate based on the information supplied by the Customer. The final price may vary depending on the actual volume, weight and nature of the Waste, the time required on Site, access conditions, and any additional work requested by the Customer.
A booking is not considered confirmed until the Company has issued a verbal or written confirmation. The Company reserves the right to refuse or cancel any booking at its discretion, including where the Customer has previously failed to comply with these Terms and Conditions.
4. Access, Parking and Customer Responsibilities
The Customer is responsible for ensuring that the Company and its operatives have safe, reasonable and lawful access to the Site at the agreed time. This includes arranging suitable parking or providing any necessary permits where on-street parking controls or restrictions apply.
If the Company incurs parking charges, penalties or other costs directly as a result of providing the Services at the Site, these may be added to the Customer's final invoice. The Customer must ensure that Waste is clearly identified and, unless otherwise agreed, reasonably close to the access point or collection area notified to the Company.
The Customer must notify the Company in advance of any access issues, security restrictions, height limits, road closures, or other factors that may affect the ability to perform the Services. If the Company is unable to carry out the Services because of inadequate access, unsafe conditions or incorrect information provided by the Customer, the Company may charge a call-out fee and any wasted costs.
5. Waste Types and Prohibited Materials
The Customer must not present for collection any Waste that is classified as hazardous or specialist unless this has been expressly agreed with the Company in advance. Prohibited materials include, but are not limited to, asbestos, clinical or medical waste, chemicals, solvents, oils, pressurised gas cylinders, explosives, radioactive materials and certain electrical items that require specialist treatment.
If prohibited Waste is found within a load, the Company may refuse to collect it, segregate it from other Waste, or cease work entirely if it is unsafe to continue. Any additional costs of dealing with such materials, including safe removal, storage or disposal, may be charged to the Customer.
The Customer remains responsible for any consequences, fines or costs arising from misdescribed Waste, failure to disclose hazardous content, or breach of applicable waste regulations. The Company will handle and dispose of Waste in accordance with prevailing UK waste legislation and industry practice.
6. Pricing and Payment Terms
Unless otherwise agreed in writing, all prices quoted by the Company are in pounds sterling and may be subject to applicable taxes. Pricing is generally based on the volume and type of Waste, labour time, and any additional services requested by the Customer.
For most domestic rubbish removal jobs, payment is due immediately upon completion of the Services, and before the vehicle leaves the Site. Payment may be made by cash, debit card, credit card or other methods accepted by the Company at the time of service.
For commercial or account Customers, payment terms will be as agreed in writing, typically within a specified number of days from the date of invoice. The Company reserves the right to conduct credit checks and request advance or part payment before commencing work.
If the actual volume or type of Waste collected exceeds the amount initially quoted, or if additional labour or time is reasonably required on Site, the final charge may be adjusted accordingly. The operative will seek to agree any significant changes to price with the Customer on Site before proceeding.
7. Late Payments and Overdue Accounts
If a Customer fails to pay any amount due by the payment date, the Company reserves the right to charge interest on the overdue sum at the statutory rate permitted under UK law, accruing on a daily basis until payment is made in full.
The Company may also recover any reasonable costs incurred in collecting overdue amounts, including legal and enforcement expenses. Continued use of Services may be suspended or refused until all outstanding sums are paid in full.
8. Cancellations and Amendments
The Customer may cancel or amend a booking by contacting the Company as soon as reasonably practicable. For standard bookings, cancellations made at least 24 hours before the scheduled arrival time will normally incur no cancellation fee.
If a booking is cancelled with less than 24 hours notice, or if the Customer is not present or does not provide access when the team arrives at the Site, the Company reserves the right to charge a reasonable cancellation or call-out fee to cover wasted time, travel and associated costs.
Where the Customer requests a change in the date, time or scope of the Services, the Company will make reasonable efforts to accommodate the request but cannot guarantee availability. Any revised price will be communicated to the Customer for approval before proceeding.
9. Service Times and Delays
The Company will use reasonable endeavours to attend the Site and complete the Services at the agreed time or within the agreed time window. However, any time for performance is an estimate only and not of the essence of the contract.
Delays may occur due to traffic conditions, weather, vehicle breakdown, prior jobs taking longer than anticipated, or other factors beyond the Company's reasonable control. The Company will aim to keep the Customer informed of any significant delays and rearrange the booking where necessary.
The Company will not be liable for any loss, damage or inconvenience suffered by the Customer as a result of reasonable delays or rescheduling, provided that the Company has acted with reasonable care and endeavoured to perform the Services within a reasonable period.
10. Customer Property and Site Condition
The Customer must ensure that the Site is reasonably prepared for the Services and that items intended to be kept are clearly separated from Waste to be removed. The Company cannot be held responsible for removing items that the Customer has not clearly identified as items to be retained.
While the Company will take reasonable care when moving Waste through the Customer's premises, the Customer accepts that minor scuffs, marks or wear may occur in tight access areas or where bulky items are being removed. The Customer should protect flooring, walls and fixtures where necessary.
If the Customer is concerned about any particular risk of damage, this must be raised with the operatives before work commences so that reasonable steps can be taken to mitigate such risk or adjust the method of removal.
11. Liability and Limitations
The Company will exercise reasonable skill and care in the performance of the Services. If the Company is found liable for loss or damage caused by its negligence or breach of contract, such liability shall, to the maximum extent permitted by law, be limited to the total price paid or payable by the Customer for the specific Services that gave rise to the claim.
The Company will not be liable for any indirect or consequential loss, loss of profit, loss of business, loss of opportunity or loss of goodwill arising out of or in connection with the provision of the Services. Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot lawfully be excluded under UK law.
The Customer is responsible for ensuring that any necessary consents, permissions or authorisations relating to the Site and the Waste have been obtained. The Company shall not be liable for any claims or penalties resulting from the Customer's failure to obtain such consents.
12. Compliance with Waste Regulations
The Company is committed to operating in compliance with relevant UK environmental and waste management legislation. Waste collected as part of the Services will be transported and transferred only to authorised facilities and will be handled with due regard to recycling and recovery obligations.
The Customer acknowledges that the Company may be required to complete and retain documentation relating to the transfer, type and origin of Waste. The Customer agrees to provide accurate information reasonably requested to enable compliance with such obligations.
The Company may refuse Service where it reasonably believes that proceeding would breach applicable waste laws or regulations. The Company may also cooperate with regulatory bodies or law enforcement in relation to investigations involving Waste handled under these Terms and Conditions.
13. Insurance
The Company maintains appropriate insurance cover in connection with the operation of its rubbish removal and waste collection activities. Details of such insurance may be provided upon reasonable request.
The Customer is responsible for maintaining any household, commercial or property insurance they consider necessary to cover their own risks and property at the Site.
14. Complaints and Dispute Resolution
If the Customer is dissatisfied with any aspect of the Services, they should raise the issue with the Company as soon as possible, providing full details of the concern and any supporting information. The Company will investigate the complaint and, where appropriate, propose a resolution such as a partial refund, re-performance of services or other reasonable remedy.
The Customer must give the Company a reasonable opportunity to address any issues before pursuing other remedies. Nothing in this clause affects any statutory rights the Customer may have under UK consumer law, where applicable.
15. Changes to Terms and Conditions
The Company may amend these Terms and Conditions from time to time to reflect changes in law, industry practice or the nature of the Services. The latest version will apply to all new bookings and will be made available upon request.
Where a booking has already been confirmed, the version of the Terms and Conditions in force at the time of confirmation will normally apply to that booking, unless a change is required by law.
16. Data Protection and Privacy
The Company may collect and process personal data relating to Customers for the purposes of handling enquiries, managing bookings, delivering Services, issuing invoices and maintaining records. Personal data will be processed in accordance with applicable data protection laws in the UK.
The Customer is responsible for ensuring that any personal information they provide is accurate and up to date. The Company will take reasonable steps to keep such information secure and will only share it with third parties where necessary for the performance of the Services, legal compliance or as permitted by law.
17. Force Majeure
The Company shall not be liable for any delay or failure to perform its obligations where such delay or failure is due to events beyond its reasonable control. Such events may include, but are not limited to, extreme weather, natural disasters, strikes, industrial disputes, civil unrest, public health emergencies, vehicle breakdowns, or actions of public authorities.
In such circumstances, the Company will use reasonable efforts to notify the Customer and resume performance as soon as reasonably practicable. If the event continues for an extended period, either party may discuss cancellation or rescheduling of the Services.
18. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
19. General Provisions
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or other competent authority, that provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable.
No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy. No single or partial exercise of any right or remedy shall prevent any further exercise of that or any other right or remedy.
These Terms and Conditions constitute the entire agreement between the Customer and the Company in relation to the Services and supersede any prior understandings, agreements or representations, whether oral or written, relating to their subject matter.
